Is this relationship legal?

A 24 year old man, who is on probation at the present time for CSC 3rd degree(person 13-15), and who as a condition of his probation, is not to have any contact with a minor under age 17, who is dating AND sleeping with a 16 year old. Should this be reported to the authorities?
